5. Right to Terminate Access and User ID

8. Intellectual Property Rights

First, you acknowledge and agree that all rights in and to the account belong to Nervous Ibex Games in perpetuity and shall inure to the benefit of Nervous Ibex Games. You acknowledge and agree that you have no ownership or other property rights in the account. If any information you provide is untrue, untrue, incomplete, not current or current, we will have the right to terminate your access to or use of the Websites and Services.

10. Virtual Items

There may be virtual currency or credits when using our services. You acknowledge and agree that virtual currency or virtual items may only be used for the purpose of use in our services and for no other purpose.

If any such agreement or performance of such agreement with such third party causes us any damage or loss, you will be jointly and severally liable to us.

You agree that the quantity, nature and quality of Virtual Currency and Virtual Goods in your Account shall be determined and calculated solely by us.

You agree not to make any transaction, sale, purchase or exchange in Virtual Currency or Virtual Goods without our prior written consent (“Non-Permitted Transaction”). You assume all risks arising therefrom. If we become aware of any Unauthorized Transaction, we have the right to terminate, suspend, stop or reverse such transaction, including, but not limited to, terminating, suspending, stopping or withdrawing Virtual Currency, Virtual Goods or your Account.

11. Subscriptions

By subscribing to any of Nervous Ibex Games’ subscription services, you are deemed to have accepted the applicable terms and conditions. These subscription services provide you with access to exclusive content, services or benefits for a recurring fee. Your subscription will continue until cancelled in accordance with our cancellation policy.

When you purchase a subscription, you agree that we (or our third-party payment processor) are authorized to collect a recurring subscription fee, any applicable taxes, and any other fees you may incur in connection with your use of the Subscription Services. Uninstalling the Application does not result in refund of the amount paid for the Application/Subscription. Nervous Ibex Games reserves the right to terminate this EULA, in its sole discretion, or request that You remove the Application from your device for any reason, including but not limited to Nervous Ibex Games’s reasonable conclusion that You have breached the terms of this EULA. Promptly upon termination, You must cease all use of the Application and destroy any and all copies of the Application in your possession or control.

Termination will not limit any of Nervous Ibex Games’s other rights or remedies in law or equity. If any of the platforms disable the ability to use the Application on your device pursuant to your agreement with such platform, any associated license rights with Nervous Ibex Games shall terminate as well.

This application is provided to the fullest extent permitted by law without any guarantee, warranty or guarantee of performance and your use is at your sole risk. Nervous Ibex Games LLC does not warrant that it will be free from defects.

The entire risk of satisfactory quality and performance is with you. Nervous Ibex Games LLC makes and disclaims all warranties, express, implied or statutory, including warranties of condition, satisfactory quality, usage, merchantability, uninterrupted, fitness for a particular purpose, non-infringement of third party rights, and warranties arising from usage or trade practice (if any).

Nervous Ibex Games LLC does not guarantee that;

• Does not warrant that the application will meet your requirements
• Does not warrant that the operation of the application will be uninterrupted or error free
• Does not warrant that your enjoyment of the application will not be interfered with
• Does not warrant that the application will work or be compatible with any other application
• Does not warrant that any errors contained in the application will be corrected
• Does not warrant that the application will be available for re-installation on the same or multiple devices

No verbal or written advice provided by Nervous Ibex Games LLC creates a warranty.
